You have already chosen to use a non-lethal form of self defense, so clearly you care about other human beings. Please keep this attitude, and don't torture someone with the pain that comes along with pepper spray unless they deserve it.
Another thing to keep in mind is that, in any fight-except maybe a tank vs. a snail-the side that attacks first USUALLY wins the fight. This is another argument for using your pepper spray as soon as you feel threatened. Think of it this way: If you felt threatened, you can articulate to a judge why you felt threatened, and the judge agrees that any reasonable person would have felt threatened in the same situation, then you are very unlikely to get into legal issues.
When to use pepper spray? Use it now! Don't hesitate; don't give your attacker the upper hand; don't wait to see what will happen next. If you feel that the safety of you or a loved one is in danger, unload your whole canister right at the attacker, and run away before calling 911.
